Ministry of Defense Takes the Lead in AI Regulation
The Brazilian Ministry of Defense has decided not to wait for the Regulatory Framework for Artificial Intelligence, which is still stalled in Congress, and has launched its own guidelines. From now on, the responsibility for the use of AI is 100% human. That's right, no blaming the machine. Additionally, migrating sensitive data to the public cloud is prohibited. The idea is to maintain technological sovereignty and protect strategic information.
The new ordinance, published in the Diário Oficial da União, states that military researchers must declare the AI used and assume full responsibility for the content generated. This applies especially to the academic activities of the Escola Superior de Guerra and the Escola Superior de Defesa. The rule is clear: any use of generative AI must be supervised, and the user is responsible for ensuring the integrity and accuracy of the information.
AI is an Ally, but with Human Responsibility
The regulation does not close the doors to artificial intelligence. On the contrary, it recognizes its value as a support tool in various areas, such as organizing work, linguistic review, and even programming. But beware, intellectual authorship must always belong to the user. AI cannot be credited as the author or co-author of any academic production. Moreover: false information or plagiarism is the user's responsibility, not the machine's.
The ordinance also addresses the risks associated with generative AI. Among them are the famous "hallucinations," which generate false information, and the leakage of sensitive data. To mitigate these risks, the regulation requires mandatory human review and verification of primary sources. Furthermore, the Escola Superior de Guerra and the Escola Superior de Defesa must promote training programs on best practices in AI use.
Governance and Training are Essential
Governance is another crucial point. Institutions need to establish a permanent structure for the approval of tools and updating internal policies. This includes analyzing aspects such as data residency and mechanisms for protection against leaks. The idea is to ensure that technology is used safely and efficiently.
